Timberlake Ranch Covenants & Restrictions (Cliffs Notes):
As many people can be scared off by Property Owners Associations with dense booklets of Covenants and Restrictions (CCRs) we thought wed simplify this and address the most commonly asked questions we get about properties in developments like this. If youd like to read the CCRs cover to cover, we have linked them here as well as in the table below. Whats provided here is simply an overview meant to answer general questions. If you have additional questions, or require clarification, its best to call the Timberlake Ranch Land Owners Association directly. Subdivisions within Timberlake Ranch: There are five subdivisions within Timberlake Ranch: Cloh Chin Toh, Timberlake (Cibola) Unit 1, Timberlake (Cibola) Unit 2, Timberlake South and McKinley Units 1-10 and certain covenants/restrictions apply to only specific units. When reviewing the document, its important to remember that this lot sits in McKinley Units 1-10.
Residential Good, Commercial Bad: These properties may only be used for Residential purposes and not for commercial, business interests. Working from home is fine if youre a writer. If you run a mechanics shop out of your garage its probably not.
Architectural Control Committee: Residencies require a permanent foundation. They may have guest houses, outhouses, tool sheds, garages, etc. though the community will want to see building plans in advance to make sure everything is up to code and conforms with the aesthetics of the development. Some people see this as a bad thing, or worry that the design committee will be too strict or obnoxious in their requirements. Typically, however, these sorts of organizations are created not to be a burden on the good residents but to prevent bad residents from constructing eye sores or leaving construction projects unfinished for long periods of time. Additionally, these committees tend to make sure everything built in their development is code compliant and there are, for instance, no fire hazards, which of course are important in wooded areas such as these. In short, this Architectural Control Committee is there to protect your investment, not to hinder your lifestyle choices.
Time Limit To Build: From the time you purchase the land you are not obligated to construct anything on it. Once your designs have been approved by the design committee and you break ground on your new home, they will want you to finish construction within 24 months. As they write in their CCRs, they want construction diligently prosecuted.
RVs, Mobile/Modular Homes & Yurts: All acceptable if used as temporary living conditions and not as permanent ones. You may use any of these on your land for up to six months at a time (for instance, if youre camping for the summer) and if youre building a permanent structure, you may live out of them during the construction period.
Airbnb: While not specifically mentioned in the CCRs, rules are enumerated about the leasing of the home on the property. In short, leasing or renting the primary residence is allowed, leasing or renting the guest house is not. As the CCRs pre-date Airbnb, we encourage you to seek clarification with the Land Owners Association.
Tiny Homes: A minimum of 600 square feet is required of whatever is built on the land.
Livestock: Acceptable if you have a permanent residence. Unacceptable if you dont.
Hunting: Not allowed.
Fireworks: Not allowed.
Storage: The lot may not be used strictly for storage purposes.
Subdivision: The lot may not be subdivided.
